PRIVACY POLICY & DATA PROTECTION

OOLIICOM SOCIEDAD ANÓNIMA informs you that, for the purposes provided in the Law on the Protection of Individuals regarding the Processing of their Personal Data No. 8968 (hereinafter, the “LPD”) and its Regulation, OOLIICOM SOCIEDAD ANÓNIMA, corporate identification number 3-101-447665, with its registered office in San José, Curridabat, 150 meters north of “Servicentro La Galera” at Oficentro De Soto, first floor (hereinafter, the “Controller”), informs you (the “User”) of the existence of a Personal Data Database created by the Controller, named “OOLii”. This Policy applies to the collection of information through the OOLii Web Application. The data you provide to the Controller is collected for informational and contact purposes, and to provide you with the corresponding services of sending digital communications. This information will be processed with the privacy, confidentiality, and security required by current legislation. The data collected is adequate, relevant, and not excessive in relation to the scope, purposes, and services determined by the Controller. Therefore, all the data requested is mandatory for the provision of the service. However, if you have consented to the processing of your data, such consent may be revoked at any time by sending an email to: datos@tecsms.com , with the corresponding consequences explained herein. Failure to provide data or refusal to consent to its processing at any time will result in the impossibility for the Controller to provide the offered service. The services provided by the Controller are intended for adults; therefore, if you are a minor, you must refrain from including or submitting any data to the Controller. The sole recipient of the information you include in the registration forms of the Web Application is the Controller itself. User Data will not be transferred, disclosed, or communicated to third parties; however, if it should become necessary, you will be informed in advance in order to obtain your consent. You may exercise your rights of access, rectification, modification, revocation, or deletion of your personal data by sending a written communication to the Controller at the following address: San José, Curridabat, 150 meters north of “Servicentro La Galera” at Oficentro De Soto, first floor, or by emailing: datos@tecsms.com . The Controller maintains security levels for the protection of your data in accordance with the Regulation of the Law on the Protection of Individuals regarding the Processing of their Personal Data, No. 37554 dated 10/30/2012, regarding database security measures. The Controller has established all technical means within its reach to prevent the loss, misuse, alteration, unauthorized access, and theft of the data you provide. Nevertheless, you are advised to take appropriate measures to ensure your device is reasonably protected against cyber-attacks, as security measures on the Internet are not infallible. REGARDING THIRD-PARTY DATA INCLUDED FOR MESSAGE DELIVERY Due to the nature of the OOLii platform, you, as the User, must include Personal Data in the system to enable the sending of different MESSAGES. By doing so, you declare that you are duly authorized to use such data for this purpose and release the Controller from any liability regarding these third parties. The Controller stores such data in the OOLii database solely to comply with its obligation to retain the MESSAGES you generate. These messages may only be accessed by you as a User of the OOLii Platform. For these purposes, the Controller is considered a Technological Intermediary with respect to the Data mentioned herein. EXPRESS ACCEPTANCE OF THIS POLICY AND INFORMED CONSENT The User accepts this Policy by checking the box next to “I have read and agree to the Privacy Policy” found in the information collection forms. Checking this box constitutes express consent to the automated processing of data in accordance with this Privacy & Data Protection Policy of the Controller. DECLARATION OF TRUTHFULNESS The services provided by the Controller are based on the trust that you are who you claim to be, and that the information you include in the contact forms is truthful, accurate, and up-to-date. Therefore, the Controller is released from any liability of any nature resulting from the lack of truthfulness, accuracy, or currency of the information you provide. In the event that the Controller suffers damages due to your failure to comply with this declaration, you shall hold the Controller harmless and, if applicable, indemnify the Controller for any damages it may suffer. REGARDING COMMUNICATIONS WITH USERS The processing of personal data and the sending of communications by electronic means complies with the provisions of the LPD, its Regulation, and applicable Consumer Rights provisions. Users who wish to may exclude themselves from this service in a simple and free manner by sending a written communication to the addresses indicated in such communications. All electronic communications sent by the Controller will clearly indicate that the sender is the Controller and the means by which you may opt out of receiving further communications. Furthermore, the Controller does not request information classified as SENSITIVE under Data Protection regulations, nor financial information. Therefore, if you receive a communication claiming to be from the Controller requesting such information, please do not reply, delete it immediately, and notify us at datos@tecsms.com so we are aware of the incident.

DISCLAIMER

The information contained in our sectorized databases has been obtained through social networks, public forums, and online forms (etc.), where it is often disclosed by the individuals themselves and made easily available through various commercial channels with their direct consent when accepting the terms and conditions. Many governments also make name and address information publicly available through web portals, such as property ownership or business registries, tax websites, and electoral rolls. Some telecommunications companies sell call history records as well as contact information, and certain Internet service providers sell browsing history along with contact details and IP addresses, all with the individual’s consent. OOLii will only display information considered non-confidential; names, exact addresses, or complete phone numbers will not be shown. This service is free of charge and is offered solely as support for SMS communication campaigns. OOLii does not sell or commercialize databases.

SERVICE LEVEL & OBLIGATIONS OF OOLIICOM SOCIEDAD ANÓNIMA

SERVICE MONITORING. OOLii guarantees the optimal operation of its system and equipment, is responsible for technical support, and undertakes to implement all necessary systems to ensure the secure transmission of information on the Website. Furthermore, it shall ensure the following: SERVICE CONTINUITY. The billing platform shall remain available 99.5% of the time, except when unforeseeable events or force majeure beyond the control of OOLIICOM SOCIEDAD ANÓNIMA occur, which prevent or limit the continuity of the service or make it impossible to provide the service. Force majeure or unforeseeable events shall mean any unpredictable event or occurrence not attributable to the obligated party, not caused by its fault, and that places said party in the absolute impossibility of fulfilling its obligation. The optimal functioning of the service may, in many cases, depend on the CLIENT’s connection with its Internet provider, the time of day in which the service is used, and in some cases, the connection with the Ministry of Finance. Since these are external causes, they cannot be attributed to OOLii. Likewise, OOLIICOM SOCIEDAD ANÓNIMA undertakes to perform all necessary updates and modifications to the platform that may be required to improve the service or repair failures, which will be implemented automatically on the platform. SYSTEM MAINTENANCE. Any necessary maintenance that may affect service continuity shall be notified to CLIENTS at least five (5) calendar days in advance. TECHNICAL SUPPORT. Any technical support request shall be attended via email at soporte@tecsms.com . OOLIICOM SOCIEDAD ANÓNIMA shall have a maximum of 24 hours to analyze the problem and notify the parties involved. The final resolution time of the issue will depend on the type of problem, as some may require more time for analysis and resolution. However, every effort will be made to resolve within three (3) business days. The maximum resolution time shall apply provided that: The issue reported by the CLIENT does not require additional development which, due to its nature, involves extra time beyond the established resolution time according to the request’s priority. In such cases, the resolution time shall include the time necessary for development and testing of the required programs. The CLIENT is immediately available to respond to any inquiries made by OOLIICOM SOCIEDAD ANÓNIMA related to the request. If the CLIENT is not immediately available, the time limits shall be extended proportionally to the delay in providing the requested information, and OOLIICOM SOCIEDAD ANÓNIMA shall not be considered responsible for delays in response times. It is demonstrated that the incident was caused by Web Platform Programming Errors. If OOLIICOM SOCIEDAD ANÓNIMA demonstrates that the reported problem was caused by factors other than Programming Errors on the platform, the maximum resolution times shall no longer apply.

REFUND POLICY

I. OOLIICOM SOCIEDAD ANÓNIMA shall proceed with the refund of money paid by the CLIENT when, due to error, the CLIENT is charged an amount greater than agreed, or when the banking entity makes an excess deduction, such as a duplicate charge. OOLIICOM SOCIEDAD ANÓNIMA will conduct a transaction validation process and apply established procedures to prevent fraud. II. To request a refund, the CLIENT must send an email to contabilidad@tecsms.com requesting a review of received payments in order to establish whether there has been an overpayment, duplicate payment, or any type of incorrect payment that justifies a refund. III. The CLIENT must provide the following information via email to contabilidad@tecsms.com : Copy of the purchase invoice. Photocopy of the identification card (both sides). Name of the bank and the client account number to which the refund will be made. The account must be in the name of the CLIENT who made the purchase. IV. Once the above information has been received, OOLIICOM SOCIEDAD ANÓNIMA shall have 10 business days to carry out all necessary procedures with the banking entity to refund the overcharged amount. The deposit time and its appearance in the CLIENT’s account statement will vary depending on the issuing bank of the card. V.
